Next Step Business Solutions LLC ("Company," "we," "us," or "our") provides business consulting, SaaS services, website design, and professional services. By using our website or engaging our services, you agree to these Terms.
1. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of the State of Missouri and applicable United States Federal Law. Any dispute not subject to arbitration shall be brought in the courts of Stone County, Missouri.
2. SUBSCRIPTIONS & AUTO-RENEWAL
Continuous Service: For recurring SaaS or consulting subscriptions, your service will automatically renew at the end of each billing cycle.
Notification: We will provide an email reminder [Insert Number, e.g., 7-30] days before renewal for any annual or long-term plans, or as required by state law (including CA and NY).
Cancellation: You may cancel at any time through your account dashboard or by emailing [Insert Support Email]. Cancellation stops future charges; however, previously processed payments are non-refundable.
3. ALL SALES FINAL & REFUNDS
Except as provided in Section 4 (Cooling-Off Rule), all sales are final. Next Step Business Solutions LLC does not offer refunds for digital services, completed consulting hours, or SaaS access already provided.
4. NOTICE OF RIGHT TO CANCEL (FTC COOLING-OFF RULE)
If you purchased services through a door-to-door sale or at a location that is not our permanent place of business:
You have the right to cancel this contract for a full refund until midnight of the third business day after the date of the transaction.
To cancel, you must contact our team and deliver a signed and dated copy of a cancellation notice to [email protected] within this timeframe.
5. PROHIBITED CONDUCT
You agree not to engage in "Prohibited Conduct," which includes but is not limited to:
Security Violations: Attempting to hack, probe, or scan the vulnerability of our forms or networks.
Data Misuse: Selling or distributing any personal information found on our platform.
Content Misconduct: Posting offensive, defamatory, or infringing content.
SaaS Integrity: Reverse engineering, data scraping, or unauthorized "botting" of our software services.
6. INTELLECTUAL PROPERTY
The Company retains all rights to its logos, videos, and proprietary consulting frameworks. Clients are granted a limited, non-transferable license to use deliverables created specifically for them. You may not resell Company templates or software code.
7. MANDATORY ARBITRATION & CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Mandatory Arbitration: You and Next Step Business Solutions LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms shall be settled by binding individual arbitrationadministered by the American Arbitration Association (AAA).
Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Small Claims Option: Notwithstanding the above, either party may bring an individual action in small claims court.
8. SMS PROGRAM DESCRIPTION
By opting into the Next Step Business Solutions LLC mobile messaging program, you agree to receive automated text messages (SMS and MMS) to the phone number provided.
Transactional Use Case: Messages may include account notifications, appointment reminders, shipping updates, and two-factor authentication codes.
Marketing Use Case: If you have specifically opted-in to marketing communications, messages may also include promotional offers, cart reminders, and business consulting alerts.
Message Frequency: Message frequency varies based on your interaction with our services and account activity.
9. OPT-OUT INSTRUCTIONS AND SUPPORT
Opt-Out & Help: You can cancel the SMS service at any time. Just text STOP to the number from which you are receiving messages. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time. For help, you can reply with the keyword HELP for more information, or contact our support team directly at [email protected]. Carriers are not liable for delayed or undelivered messages.
10. MESSAGE & DATA RATES AND AGE RESTRICTION
Rates & Eligibility:
Costs: As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Age Restriction: You must be strictly 18 years of age or older to use our website or subscribe to our SMS program. By providing your phone number and opting in, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. If we learn that a user is under the age of 18, we will terminate their account and delete their information immediately.
11. LIMITATION OF LIABILITY
No Guarantee of Results: We provide tools and expertise; however, business growth is dependent on many factors. We do not guarantee specific revenue increases or business outcomes.
Technical Errors: We are not liable for temporary service interruptions, technical glitches, or loss of data due to third-party hosting issues.
